Tunelingo Terms of Service

These Terms of Service ("Terms") govern your use of the Tunelingo mobile application and website (the "Service"), operated by Dombyte Studio, established in the Netherlands and registered with the Dutch Chamber of Commerce (KvK) under number 42083302 ("Tunelingo", "we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Your use of the Service is also subject to our Privacy Policy, which explains how we handle your data. If you downloaded the app from the Apple App Store or Google Play, the store's own terms also apply to your purchase and use of the app.

1. The Service

Tunelingo generates personalized songs using artificial intelligence to help you learn languages. You choose a target language, level, genre, and topic; the Service generates a song with synchronized lyrics, phonetics, and translations, and provides study tools such as saved vocabulary and spaced-repetition flashcards.

If you subscribe, you can also use Real songs: you import an existing song from YouTube and study it with the same tools. Real songs play through YouTube's embedded player and are governed by Section 6.

Tunelingo is a learning aid, not professional language instruction. Song lyrics, translations, phonetics, and vocabulary annotations are generated by AI (for real songs, the lyrics themselves come from third-party sources and the annotations around them are generated by AI) and, despite our best efforts, may contain errors, awkward phrasing, or inaccuracies. Do not rely on generated content where accuracy is critical (for example, exams, legal, medical, or professional translation needs).

We continuously develop the Service and may add, change, or remove features. Where a change materially reduces what you have paid for, Section 13 (Changes) applies.

2. Eligibility and your account

• You must be at least 13 years old (or the higher minimum age that applies in your country) to use the Service.
• You must provide accurate account information and keep your login credentials confidential. You are responsible for activity that happens under your account.
• One account per person. You may not share, sell, or transfer your account.
• You may sign in with email and password, Google, or Apple. Third-party sign-in is subject to that provider's own terms.

3. Subscriptions

Tunelingo offers auto-renewing subscriptions ("Starter" and "Plus"), billed monthly or yearly through the Apple App Store or Google Play:

• Each subscription includes a monthly allowance of song generations (as shown on the paywall at the time of purchase). Unused allowance expires at the end of each monthly cycle — it does not roll over, accumulate, or convert into credits. This applies to yearly plans too: yearly billing changes how you pay, not how the monthly allowance works.
• Each subscription also includes access to Real songs (Section 6) at no additional charge. This access lasts only while the subscription is active. Imported songs are not purchased and do not become yours: see Section 6.4.
• Prices are shown in the app before purchase. The store may charge in your local currency and applicable taxes may be added, per the store's rules.
• Auto-renewal: subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. Payment is charged to your App Store or Google Play account.
• Cancelling: manage or cancel your subscription in your App Store or Google Play subscription settings — cancelling in your device settings is the only way to stop renewal; deleting the app or your Tunelingo account does not cancel a store subscription. After cancelling, you keep subscription access until the end of the paid period.
• Price changes: if we change subscription prices, the change applies per the store's price-change rules, which include advance notice and, where required, your consent. If you do not agree, you can cancel before the new price takes effect.

4. Credit bundles

You can also buy one-time credit bundles:

• Bundle credits are prepaid song-generation credits. They do not expire and remain yours if a subscription lapses or is cancelled.
• Discounted member pricing for bundles is available only while you hold an active Starter or Plus subscription.
• Credits have no monetary value, are not exchangeable for cash, and are non-transferable. They can only be spent on song generation inside the Service. Credits do not unlock Real songs, which requires an active subscription (Section 6).
• We may occasionally grant free promotional credits (for example, a welcome credit when you create an account). Promotional credits behave like bundle credits unless we state otherwise when granting them, and promotional offers may be changed or withdrawn at any time for new accounts.

5. Song generation, charges, and automatic refunds

This section applies to songs you generate. Songs you import with the Real songs feature are covered by Section 6; importing never consumes your allowance and never costs credits.

• Generating a song consumes one song from your subscription allowance (used first, when available) or one credit. Songs with a requested length of 2 minutes or more consume two credits when paid with credits; a subscription-allowance song always counts as one song regardless of length.
• After you tap Generate, there is a short cancellation window during which you can cancel at no charge. Once the request is sent, the charge applies.
• Generation is asynchronous and typically takes up to a few minutes. We do our best to make generation fast and reliable, but generation times are not guaranteed.
• Failed generations are automatically refunded to your credit balance (or your allowance is not consumed). You do not need to contact support for a failed song.
• Song length is an estimate. The duration you select is a target passed to the AI music provider, not a guarantee — generated songs almost never match the requested length exactly and may come out shorter or longer. Requesting a duration does not entitle you to a song of exactly that length.
• Short-delivery refund: if you paid two credits for a 2-minute-plus song and the delivered song is shorter than 2 minutes, the one-credit difference is refunded automatically.
• Content review: song requests pass through automated safety review. A request that is declined (for example, because the topic violates Section 9) is treated as a failed generation and refunded. Repeated attempts to generate prohibited content may lead to account action under Section 11.
• Identical requests may produce shared songs. To keep the Service affordable, an identical song request (same language, level, genre, text, and settings) may be fulfilled with a previously generated song rather than a brand-new generation, and songs you generate may likewise be served to other users who make an identical request. Section 8 explains what rights you have in generated songs.

6. Real songs (imported from YouTube)

Real songs lets you take a song you already know and study it in Tunelingo with the same tools as a generated song: time-synchronized lyrics, phonetics, translations, tap-to-learn words, and saved vocabulary.

6.1 Who can use it, and what it costs

• Real songs is available only while you hold an active Starter or Plus subscription.
• Importing a song does not consume your monthly song allowance and does not cost credits. It is included in your subscription at no additional charge.
• Credit bundles alone do not unlock Real songs. A credits-only account cannot import songs.
• Import capacity is subject to fair use and to limits our third-party providers place on us. We do not offer unlimited imports, and we may apply daily or per-account limits so the feature stays available to everyone.

6.2 How importing works

• You search for a song in the app or paste a YouTube link, confirm the track, and we prepare the lesson around it. Preparation usually takes a short time; a song already prepared for the same language pair is made available to you immediately.
• Not every song can be imported. Availability depends on the track's length and on whether time-synchronized lyrics exist for it. Where we cannot prepare a song properly, we tell you rather than deliver an incomplete lesson.
• We may remove an imported song from the Service, or a song may stop being playable, for reasons outside our control (Section 6.3). No refund is due for an import, because imports are not separately paid for.

6.3 Playback happens on YouTube

• Real songs play through the official embedded YouTube player inside the app. We do not host, copy, download, or store the audio or video.
• Because playback runs through that player: an internet connection is required, the video stays visible while it plays, and there is no offline, background, or lock-screen playback for real songs.
• YouTube may show its own advertising before or during playback. This is outside our control. Tunelingo's own commitment not to show advertising applies to the Service itself, not to YouTube's player.
• Your use of the embedded player is also subject to the YouTube Terms of Service and the Google Privacy Policy.
• Tunelingo is not affiliated with, endorsed by, or sponsored by YouTube or Google. A video can be removed, restricted, made private, or geo-blocked by its owner or by YouTube at any time, and we cannot restore playback when that happens.

6.4 Imported songs are access, not a purchase

You never buy an imported song. It is not paid for with credits or with your monthly allowance, so access to imported songs depends on holding an active subscription.

• If your subscription ends, lapses, or is cancelled, imported real songs stay visible in your library but are locked and cannot be played or studied until you subscribe again. We do not delete them.
• If you subscribe again, access to your imported songs is restored at no extra charge.
• You keep, whatever happens to your subscription: every word you have saved (including words saved from real songs), your review progress, your streaks, statistics, and level progress, and every song you generated using your allowance or your credits.

This is disclosed on the paywall before you purchase.

6.5 Lyrics, translations, and rights

• Lyrics for real songs are obtained from third-party lyrics sources and belong to their rights holders. The timing, phonetics, translations, and vocabulary annotations we display around them are produced automatically for study purposes.
• Lyric text, timing, and translations may be incomplete, mis-timed, or inaccurate, and sync quality varies between songs. Section 1 (learning aid, not professional instruction) applies to real songs in full.
• Real-song lyrics are third-party content that we neither write nor filter. They may contain explicit, offensive, or adult language. Choose your imports accordingly.
• You acquire no rights in any real song, its recording, its artwork, or its lyrics. You may play and study them inside the Service only, and only for as long as you have access.
• If you are a rights holder and believe content shown in the Service infringes your rights, contact us at legal@tunelingo.app with enough detail to identify the content. We will review and remove infringing content promptly.

7. Payments, store refunds, and EU withdrawal right

• All payments are processed by Apple or Google. We do not receive or store your payment card details.
• Refunds for purchases are handled by the store you bought through, under its refund policy: for Apple, via reportaproblem.apple.com; for Google Play, via the Play Store's refund process. We cannot issue App Store refunds ourselves.
• EU/EEA consumers — right of withdrawal: you normally have a 14-day right to withdraw from a purchase of digital content or services. For subscriptions and credits bought through the App Store or Google Play, this right is exercised through Apple or Google under their withdrawal procedures. By purchasing credits and using them to generate songs within the withdrawal period, you request immediate performance and acknowledge that, to the extent permitted by law, you lose the right of withdrawal for credits already spent.
• Nothing in this section limits your mandatory statutory rights as a consumer, including remedies under EU digital-content conformity rules if the Service does not perform as agreed.

8. Content and intellectual property

8.1 Our property

The Service — including the app, website, design, branding, code, and all software — is owned by Dombyte Studio or its licensors and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on your own devices for personal, non-commercial purposes. You may not copy, modify, distribute, sell, reverse engineer, decompile, or create derivative works of the Service except where the law expressly permits it.

8.2 Your input

You retain any rights you hold in the text you enter (such as song topic ideas). By submitting input, you grant us a worldwide, royalty-free license to process it — including sending it to our AI service providers — for the purpose of generating songs and operating the Service. Do not include personal data or confidential information in song prompts; prompts can produce shared content served to other users (Section 5).

8.3 Generated songs

Songs generated by the Service (audio, cover art, lyrics, phonetics, translations, and vocabulary annotations) are created by AI systems, may be shared with other users who make an identical request, and are hosted by us as part of the Service catalog. Accordingly:

• You receive a personal, non-exclusive, non-transferable, non-commercial license to play, stream, and study generated songs within the Service for as long as you have access to them.
• You do not acquire ownership of, or exclusive rights to, any generated song, and you may not distribute, publish, publicly perform, monetize, or commercially exploit generated songs outside the Service.
• We (and our AI providers, to the extent their terms provide) retain all remaining rights in generated content, including the right to store it, serve it to other users with identical requests, and remove it.
• AI-generated output is not unique to you: similar prompts by different users may produce similar or identical output, for you or for others.

8.4 Feedback

If you send us suggestions or feedback, we may use them without restriction or compensation.

9. Acceptable use

You agree not to:

• use the Service for any unlawful purpose, or submit prompts intended to produce content that is illegal, hateful, harassing, sexually explicit involving minors, or that infringes anyone's rights;
• include another person's personal data in prompts, or impersonate any person or entity;
• attempt to bypass, probe, or overload the Service's security, rate limits, payment checks, quota enforcement, or refund mechanisms;
• access the Service by automated means (bots, scrapers) or extract content from it in bulk;
• rip, re-record, redistribute, or commercially exploit generated songs outside the Service (Section 8.3);
• download, record, capture, or otherwise copy the audio or video of a real song, or bypass, modify, or replace the embedded YouTube player, or use the Service to obtain content from YouTube outside that player;
• import songs for any purpose other than your own personal study, or use imported lyrics, translations, or annotations outside the Service;
• interfere with other users' use of the Service;
• use the Service to build a competing product or to train machine-learning models.

We may remove content and take account action (Section 11) for violations of this section.

10. Third-party services

The Service depends on third-party providers — including AI generation services, YouTube (video search and embedded playback for real songs), third-party lyrics sources, app stores, payment processing, cloud hosting, analytics, and push-notification delivery (listed in our Privacy Policy). We are responsible for the Service we provide to you, but we do not control these providers, and temporary failures or changes on their side (for example, an AI provider outage) can affect generation availability. Where a paid generation fails for any reason, the automatic refund rules in Section 5 apply.

Real songs depend on YouTube and on third-party lyrics sources in particular. If those providers change their terms, restrict our access, or remove content, the feature may be limited, interrupted, or discontinued. Because imports are included in your subscription rather than paid for individually, no refund is due for an individual song that becomes unavailable. If Real songs becomes permanently unavailable as a whole, Section 13 (Changes) and your statutory rights apply.

11. Suspension and termination

By you: you may stop using the Service at any time and delete your account in the app (Settings → Delete account). Account deletion is subject to a 14-day recovery window, after which your data is permanently deleted as described in the Privacy Policy. Deleting your account does not cancel an active store subscription (Section 3) and does not entitle you to a refund of unused subscription time; unused bundle credits are forfeited when the deletion becomes permanent, so spend them first.

By us: we may suspend or terminate your access, with notice where reasonably possible, if you materially or repeatedly breach these Terms, if required by law, or if your account is used fraudulently. In cases of serious breach (for example, fraud, abuse of refund or quota mechanisms, or repeated prohibited-content attempts), we may terminate immediately and any remaining credits are forfeited to the extent permitted by law. If we terminate your access without cause, we will refund a proportionate part of prepaid amounts for the unused period or unused credits.

Discontinuing the Service: if we discontinue the Service entirely, we will give reasonable advance notice, and EU consumers retain their statutory remedies for prepaid, undelivered performance.

12. Disclaimers and liability

• The Service is provided with reasonable skill and care. Beyond what these Terms and mandatory law provide, the Service is provided "as is" and we make no warranty that it will be uninterrupted, error-free, or that generated content will meet your expectations of quality, accuracy, or length.
• AI-generated content may be inaccurate (Section 1). We are not liable for decisions you make in reliance on generated translations or explanations.
• We do not warrant that any particular song can be imported, that lyrics or timing for a real song are accurate or complete, or that an imported song will remain playable. Real songs depend on third parties (Section 6.3, Section 10).
• Nothing in these Terms excludes or limits liability for intent or gross negligence (opzet of bewuste roekeloosheid), for death or personal injury caused by our negligence, or any liability or consumer right that cannot be excluded or limited under applicable law — including your statutory conformity remedies as an EU consumer (repair, price reduction, or termination where digital content does not conform).
• Subject to the above, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) €50.
• We are not liable for indirect or consequential damages (such as loss of data caused by circumstances outside our control, or lost profits) except where mandatory law provides otherwise.

13. Changes to these Terms

We may update these Terms as the Service evolves. The "Last updated" date above reflects the current version. For material changes, we will notify you in the app or by email at least 30 days before they take effect, unless a shorter period is required for legal or security reasons. If you do not agree to a material change, you may stop using the Service and cancel your subscription before the change takes effect; continued use after the effective date constitutes acceptance.

14. Apple App Store terms

If you downloaded Tunelingo from the Apple App Store, the following also applies:

• These Terms are between you and Dombyte Studio only — not Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for the app.
• In the event the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• Apple is not responsible for addressing any claims relating to the app, including product liability claims, legal-compliance claims, or consumer-protection claims.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law and disputes

These Terms are governed by the laws of the Netherlands. If you are a consumer residing in another country, you also keep the protection of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings in the courts of that country.

16. General

• Severability: if any provision of these Terms is found invalid, the rest remains in effect, and the invalid provision is replaced by a valid one that comes closest to its intent.
• No waiver: our failure to enforce a provision is not a waiver of it.
• Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, with notice to you.
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and Dombyte Studio regarding the Service.
